Public Hearing
M. Ellis called the Public Hearing to order at 7:34. J. Poole was seated for T. Murphy.
PZC2010-16 ~Application for Special Permit to open restaurant at 11 Phelps Way (Map 30 Lot 14 Zone DC) Owner: C & S Willington LP Applicant: Luciano Conforto (Received May 4, 2010 Public Hearing ~June 1, 2010 Decision within 65 days after close of P.H.)
M. Ellis said the applicant asked for an extension due to a lengthy letter from Eastern Health District that needs to be addressed. The owner of Track nine asked for information on the application. S. Yorgensen read from the application that it is for breakfast, lunch and ice cream from Monday through Saturday, 6:30 am to 8:00 pm. A discussion was held on the seating. The application states 8 tables, seating 32 people.
J. Poole motioned to continue the Public Hearing to June 15, 2010. P. Nevers seconded the motion. All in favor.
Regular Meeting
E. Standish motioned to add the following application to old business. P. Nevers seconded the Motion. All in favor.
PZC2010-18 to allow a timber harvest at 22 Willington Hill Road (Map 23, Lot 20, R-80 Zone) Owner Mary and David Krivanec Applicant: Hull Forest Products, Inc.
Old Business
PZC2010-3 ~Application for Modification to Special Permit ~Final Site Development Plan to add ~in the future a 25’X35’ 3 sided pole building at 49 Hancock Road (Map 38 Lot 20 Zone R80)Owner/Applicant: Town of Willington (Received March 16, 2010 Decision by ~May 18, 2010 65 day extension granted by August 17th)
This application was tabled.
PZC2010-18 to allow a timber harvest at 22 Willington Hill Road (Map 23, Lot 20, R-80 Zone) Owner Mary and David Krivanec Applicant: Hull Forest Products, Inc.
J. Poole motioned to approve the application with the following conditions:
1. State Driveway Permit to be submitted prior to the start of the harvest.
2. All skid trails and landing be seeded and mulched at completion of harvest.
3. Harvest to be done during dry season.
4. Hours of operation to be Monday – Friday, 7:00 am to 7:00 pm. No cutting on Saturdays, only truck hauling is allowed 8:00 am to 4:00 pm. No work of any kind on Sunday.
5. Any revision to the landing area or driveway cut to be reviewed and approved by staff.
J. Sullivan seconded the motion. All in favor.
New Business
PZC2010-19 Application to amend Subdivision Regulation Chapter VI section 3-I pertaing to underground propane storage tank Applicant: Northeast Oil & Propane, Inc. (Received May 18, 2010 Public Hearing June 15, 2010 Decision within 65 days after close of P.H.)
J. Poole asked S. Yorgensen to get input from the Fire Marshal regarding this application. A brief discussion was held on underground tanks. J. Poole asked about access to IAA to inquire about consequences. S. Yorgensen will talk to Attorney Mark Branse.

M. Ellis will call Teri Haun and check on her progress.
Correspondence
1. WINCOG letter re: Town of Ellington Planning and Zoning Commission.
2. Copy of the State of Connecticut DEP Reissuance of the General Permit for the Discharge of Stormwater Associated with Industrial Activity (without modifications).
3. Letter from Aspen Square to Planning and Zoning regarding of the Notice of Violation.
Minutes
M. Ellis motioned to approve the minutes of May 18, 2010. J. Sullivan seconded the motion. P. Nevers abstained. All others in favor.
Staff Report and Discussion
A discussion was held on the Ruby Road Reclamation Plan.
A discussion was held on the zone change the Town of Willington applied for.
A discussion was held on the modular requested by the bus company. The Commission will review this application if it goes forward.
